Agreement to these terms

These Terms & Conditions are an agreement between you and Consciously Aware LLC (“Consciously Aware,” “we,” “us,” or “our”), a Florida limited liability company operating consciouslyaware.com.

By using this website, submitting a form, booking a call, attending a session, or purchasing a service, you agree to these terms. If you do not agree with them, please do not use the site or our services.

You must be at least 18 years old to book or purchase from us.

What Consciously Aware is — and is not

Read this section even if you skip the rest.

Consciously Aware provides holistic wellness coaching, group sessions, functional energy assessments, speaking, and educational resources. All of it is for education, self-understanding, and personal growth.

We are not medical doctors, licensed psychologists, licensed therapists, dietitians, or licensed mental health counselors, and nothing we offer is the practice of medicine, psychotherapy, or any licensed healthcare profession. Our services:

  • Do not diagnose, treat, cure, or prevent any medical or psychological condition.
  • Are not a substitute for care from a qualified licensed professional.
  • Do not create a doctor–patient, therapist–client, or other licensed professional relationship.

Functional energy assessments are wellness and educational tools. They are not medical diagnostic tests, they are not FDA-approved for diagnosing disease, and their results should not be used in place of medical testing or advice from your physician.

Never disregard professional medical advice, or delay seeking it, because of something you read here or discussed in a session.

If you are in crisis or experiencing a medical emergency, call 911 or go to your nearest emergency room. In the United States you can also call or text 988 to reach the Suicide & Crisis Lifeline.

Your responsibility for your own wellbeing

You remain responsible for your own health, decisions, and results. By working with us you confirm that:

  • You are participating voluntarily and are capable of making your own decisions.
  • You will consult a qualified professional about any medical or mental health concern, and will keep taking prescribed medication unless the prescribing provider tells you otherwise.
  • You will tell us about any condition, injury, or limitation that could affect your safe participation, particularly in movement or breath-based work.
  • You understand that results vary, that nothing we say is a guarantee of any particular outcome, and that any testimonial on this site reflects one person’s experience rather than a promise about yours.

Our services

We currently offer 1:1 coaching (virtual), Reset Circle group sessions (in person in Wesley Chapel, Florida), functional energy assessments across the Tampa Bay area, speaking engagements, workshops and events, and free and paid digital resources. Details, formats, and availability are described on the relevant pages of this site and may change.

Descriptions on the site are offers to discuss work together, not binding contracts. A booking becomes final when we confirm it.

Booking, cancellation, and rescheduling

  • Appointments are booked through our online scheduler or by arrangement with us, and are confirmed by email.
  • Please give at least 24 hours’ notice to cancel or reschedule a 1:1 session. Within 24 hours, or if you do not attend, the session is treated as used and is not refunded or rescheduled.
  • We hold your appointment slot for 15 minutes past the start time. After that the session is treated as a no-show.
  • If you are late, the session still ends at its scheduled time so the next person is not kept waiting.
  • If we have to cancel or reschedule, you get the choice of an alternative time or a full refund of anything paid for that session.
  • Event and group session registrations may carry their own cancellation terms, which are stated at the point of registration and take precedence over this section.

Fees and payment

Fees are quoted before you commit and are payable in advance unless we agree otherwise in writing. Package and program fees may be paid in instalments where offered; missing an instalment may pause access until it is resolved. Prices may change at any time, but never for a service you have already paid for. You are responsible for any applicable taxes.

Refunds

Because coaching is a personal service delivered in real time, we do not offer refunds for sessions already delivered, for missed sessions, or for the unused portion of a package once the work has begun.

Digital products and downloadable resources are non-refundable once accessed or downloaded. Event tickets are non-refundable within seven days of the event but may be transferred to another person with notice to us.

If something has genuinely gone wrong, tell us. We would rather hear about it and make it right than have you quietly disappointed.

Group sessions and confidentiality

Reset Circles and other group formats depend on people being able to speak honestly. By joining one you agree that what is shared in the room stays in the room: no naming participants, repeating their stories, or recording audio, video, or photographs without everyone’s explicit consent.

We hold this standard and enforce it, but we cannot guarantee the behaviour of other participants. Please share at a level you are comfortable sharing in a group.

In-person sessions and assumption of risk

Some of our work involves movement, breathwork, somatic exercises, and physical presence in a studio space. These carry inherent risks, including physical discomfort, emotional release, dizziness, and injury. By participating in person you voluntarily assume those risks, confirm you are physically able to take part, and agree to stop and tell us immediately if anything feels wrong.

Text message program

Consciously Aware operates a text messaging program for clients and people who have asked to hear from us. These are its terms.

What the program is for. We use text messages for:

  • Appointment confirmations, reminders, and changes to a scheduled time.
  • Replies to questions you have texted or asked us.
  • Practical details for events, workshops, and Reset Circle sessions you registered for — directions, parking, what to bring, a last-minute room change.
  • Follow-up after a session, where you have asked for it.
  • News, event invitations, and occasional offers, only if you separately opted into marketing messages.

How you join. You opt in by ticking the consent box on a form on this website, writing your mobile number on an intake or registration form, texting us first, or telling us directly that you would like reminders by text. We do not buy phone numbers or add anyone who has not given us their number themselves.

Consent is not a condition of purchase. You are never required to agree to marketing texts in order to book, buy, or attend anything.

Message frequency. Frequency varies with your bookings and the events you register for. Most people receive a few messages a month.

How to opt out. Reply STOP to any message from us and you will be unsubscribed immediately; you will receive one final message confirming it, and nothing after that. You can rejoin at any time by texting START or asking us.

Message and data rates may apply. Your mobile carrier’s standard messaging and data charges apply to every message you send or receive. We do not charge for the messages themselves; your plan may. Check with your carrier if you are unsure.

Carrier liability. Mobile carriers are not liable for delayed or undelivered messages. Delivery depends on your carrier’s network and your handset, and neither is under our control. Do not rely on a text message to reach us in an emergency.

Your mobile information is not shared. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes, and text messaging originator opt-in data and consent are never shared with any third party. See our Privacy Policy for the full detail.

Supported carriers include AT&T, Verizon, T-Mobile, US Cellular, Metro by T-Mobile, Cricket Wireless, Boost Mobile, Google Fi, and most other US carriers. Carrier support can change without notice to us.

Email communications

By giving us your email address you agree that we may contact you about your bookings and the services you enquired about, and — if you opted in — with newsletters, event invitations, and offers. Every marketing email carries an unsubscribe link at the bottom, and unsubscribing is permanent unless you ask to rejoin. See our Privacy Policy for the detail.

Intellectual property

Everything on this site — text, images, the AWARE Method and its framework, course and workshop materials, worksheets, audio, video, logos, and design — is owned by Consciously Aware LLC or used under licence, and is protected by copyright and trademark law.

You may read, download, and print our materials for your own personal, non-commercial use. You may not copy, republish, sell, licence, teach from, or create derivative works from them without our written permission. Materials provided as part of a paid program are for the registered participant alone and may not be shared, resold, or distributed.

Content you provide

If you send us a testimonial, review, photograph, or other content, you grant us a non-exclusive, royalty-free, worldwide licence to use it in our marketing, on this site, and on social media, with attribution as you have given it. You confirm the content is yours to give and does not infringe anyone else’s rights. Tell us at any time if you want it taken down, and we will remove it from anything we control going forward.

Acceptable use

Please do not use this site to break the law, harass anyone, impersonate anyone, scrape or harvest data, upload malicious code, attempt to gain unauthorised access to any part of our systems, or interfere with the site’s operation. We may suspend or refuse service to anyone who does.

We may also end a coaching relationship, with a pro-rata refund of unused prepaid sessions, if continuing would be unsafe, unproductive, or outside our scope of practice — including where someone would be better served by licensed clinical care.

Third-party services and links

The site relies on third-party tools for scheduling, forms, payments, and analytics, and links to platforms we do not control. We are not responsible for those services or for what happens on those sites, and their terms and privacy policies apply once you are there.

Disclaimer of warranties

The website and our services are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, error-free, or free of harmful components, or that the information on it is complete, current, or applicable to your situation.

Limitation of liability

To the fullest extent permitted by Florida law, Consciously Aware LLC, Dr. Tanya Lea, and anyone working with us will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or emotional distress, arising out of your use of this site or our services — whether the claim is framed in contract, tort, or anything else, and even if we were told such damages were possible.

Where liability cannot be excluded, our total liability for any claim is limited to the amount you actually paid us for the service the claim relates to in the 12 months before it arose.

Nothing here excludes liability for gross negligence, willful misconduct, or anything else that cannot lawfully be limited.

Indemnification

You agree to indemnify and hold harmless Consciously Aware LLC, its members, and its contractors from any claim, loss, liability, or expense (including reasonable legal fees) arising out of your use of the site or services, your breach of these terms, or your violation of anyone else’s rights.

Resolving a disagreement

If something goes wrong, contact us first at info@consciouslyaware.com and give us 30 days to put it right. Most things end there.

If they don’t, these terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules, and any dispute will be brought exclusively in the state or federal courts serving Pasco County, Florida. You and we each consent to the jurisdiction of those courts.

Changes to these terms

We may update these terms from time to time. The “last updated” date at the top shows the current version, and material changes will be flagged on the site before they take effect. Continuing to use the site or our services after a change means you accept the revised terms. The terms in force on the day you book a service are the ones that apply to that booking.

General

If any provision of these terms is found unenforceable, the rest stays in force. Our not enforcing something once does not waive our right to enforce it later. You may not transfer your rights under these terms without our consent; we may assign them in connection with a sale or reorganisation of the business. Together with our Privacy Policy and any separate agreement you sign for a specific program, these terms are the whole agreement between us.
